Zoom chief says internal process failure led to ToS change

Changes in the terms of service for the communications platform Zoom, made in March 2023, were due to an internal process failure that would be fixed, the founder and chief executive of Zoom, Eric Yuan, has said.

In a series of tweets (or xeets, take your pick), and also on LinkedIn, Yuan said on Wednesday of the change that has caused much discussion about Zoom's use of private data for training its AI, "We had a process failure internally that we will fix. Period.

"Let me be crystal clear - for AI, we do NOT use audio, video, screen share, or chat content for training our AI models without customer explicit consent."

This week, as iTWire reported, Zoom was forced to issue a clarification after it was noticed that a March change in ToS said data from calls could be used to train the company's AI.

The changes were first noticed and highlighted on the Hacker News forum.

Yuan wrote: "It is my fundamental belief that any company that leverages customer content to train its AI without customer consent will be out of business overnight.

"Given Zoom's value of care and transparency, we would absolutely never train AI models with customers' content without getting their explicit consent.

"If you use our two new generative AI features that have been available on free trial for two months, you can see in the UI that we definitely ask customers if they want to opt-in to share content to improve our products and train our AI models."

Responses to his post on LinkedIn showed that Yuan had not fully cleared up the mess.

IP and trade secrets lawyer Nicole Galli responded: "While this is encouraging, it doesn’t fully solve the issue — as I have read the terms, this blog post and the other one your company put out in response to this issue — a fair reading is that by using the service we are giving consent to Zoom the ability to do basically whatever you want.

"No one is saying that Zoom or any other company is trying to use data 'without consent' - but rather that consent is being presumed via use of the service. That is unacceptable for this kind of thing.

"More clarity is needed in the terms of service that simply using your service is NOT providing consent to the use of our 'audio, video, screen share, or chat content for training' — or a licence to use it for any other purpose — but rather customers will need to separately and affirmatively consent to the use.

"Without that kind of CLEAR AFFIRMATIVE AND EXPRESS consent being required, as an attorney I am not going to be comfortable having attorney-client communications via Zoom."

Another LinkedIn user, Alasdair Pressney, asked: "In the period between March and today, what will happen to the data Zoom collected on us? If I were to submit a GDPR access request, would you be able to provide me my personal data, or delete it upon request?"

Yuan did not give any indication that there would be further changes to the ToS to fix the issue.
