Judge gives go-ahead for anti-trust suit against Google over search

A federal judge in Washington has cleared the way for a government lawsuit against Google over alleged blocking of competition in the search market to proceed from 12 September.

US District Judge Amit Mehta ruled on Friday that a central part of the case should be heard, though he did allow some claims to be removed, the Financial Times reported.

The case, filed in October 2020 by the Federal Government and joined by 38 states, said it was stopping Google "from unlawfully maintaining monopolies through anti-competitive and exclusionary practices in the search and search advertising markets and to remedy the competitive harms".

The US Department of Justice said at the time Google, as a company that did not lack money given its market value of US$1 trillion (A$1.4 trillion), was the monopoly gatekeeper to the Internet for billions.

"For years, Google has accounted for almost 90% of all search queries in the US and has used anti-competitive tactics to maintain and extend its monopolies in search and search advertising," it said.

Last year, the DoJ accused the search behemoth of making "excessive and intentional efforts" to misuse its attorney-client privilege and hide business documents relevant to the case.

On Friday, Justice Mehta said the main claim of the anti-trust case — that Google's alleged monopoly in search violates US law — should proceed.

Removed from the case was an allegation that Google's agreements relating to its Assistant and compatibility with devises running Android were against the law.

Justice Mehta also dismissed claims brought by Colorado state and Google treated of companies in specific sectors dampened competition in search.

Google's chief legal officer Kent Walker said in a statement sent to the FT: "We appreciate the court’s careful consideration and decision to dismiss claims regarding the design of Google Search.

“People have more ways than ever to access information, and they choose to use Google because it’s helpful. We look forward to showing at trial that promoting and distributing our services is both legal and pro-competitive.”
