5月23日，一份网传小米人力资源部发出的内部邮件在网上广为流传。邮件显示，小米国际部员工汪凌鸣因违反《中华人民共和国治安管理处罚法》第四十四条之规定，被公安机关予以行政拘留五日处罚。“公司对这类违法行为坚决持零容忍态度，国际部管理层经讨论决定对汪凌鸣予以辞退。”
