特斯拉起诉特斯拉啤酒 因后者使用TESILA标识
站长之家（ChinaZ.com）6月13日 消息:企查查App显示，近日，特斯拉（上海）有限公司新增一条侵害商标权纠纷开庭公告。特斯拉起诉称，中饮食品在啤酒及苏打酒产品上使用标识“TESILA”构成了侵权。
而中饮食品辩称，中饮公司所享有的第13113593号“特斯拉”商标的注册时间早于被上诉人涉案商标的注册时间。
此外，中饮食品还表示“特斯拉”“TESLA”是塞尔维亚裔美籍科学家尼古拉・特斯拉的名字，早已是广为知晓的词汇，且已由不同主体在各个类别申请注册为商标，并非原告专用、独创的商标名称，缺乏显著性，不能因为特斯拉汽车后来形成知名度就无限制扩大其保护范围。
据了解，上述案件将于6月23日开庭。
